Supreme Court rules in favor of the Trump administration on the ending of TPS for certain groups

In a 6-3 decision, the U.S. Supreme Court ruled that the federal government holds broad authority to end Temporary Protected Status designations, clearing the path for the administration to terminate humanitarian deportation protections for hundreds of thousands of foreign nationals.

The ruling rejected legal challenges brought by affected immigrants and advocacy groups who argued that the Department of Homeland Security unlawfully terminated protections for nationals from countries including Haiti and Syria. The plaintiffs contended that the cancellations violated the Administrative Procedure Act, failed to consider dangerous conditions on the ground in the affected nations, and were driven by unconstitutional racial animus.

Writing for the majority, Justice Samuel Alito stated that federal immigration statutes grant the executive branch significant discretion to determine when conditions in designated foreign countries no longer warrant deferred deportation and work authorization. The majority concluded that the administration’s stated policy rationales rested on permissible statutory grounds rather than unlawful discrimination, and it sharply restricted the scope of federal judicial review over executive TPS determinations.
