Biden’s doctor invokes Fifth Amendment in Oversight Committee probe
News | By Easton Martin | July 9, 2025
Dr. Kevin O’Connor, President Biden’s longtime physician, invoked his Fifth Amendment right during a closed-door deposition with the House Oversight Committee on Tuesday. The committee, led by Rep. James Comer, is investigating whether Biden’s physical or mental health was misrepresented during his presidency.
O’Connor, who has treated Biden for over a decade, also declined to answer questions on the grounds of doctor-patient confidentiality. His attorney cited an ongoing Justice Department criminal investigation as further justification for invoking the Fifth Amendment.
Republicans on the committee argue that O’Connor’s refusal to answer key questions suggests a possible cover-up. Democrats, however, defended his decision, saying he is legally and ethically bound to protect medical privacy and cannot discuss confidential matters.
The investigation has expanded to include top former Biden aides, including Jeff Zients, Ron Klain, and Neera Tanden. At issue is whether the administration misled the public about Biden’s health, including his reported use of an autopen to sign documents during crucial moments.
