Planned Parenthood may be in big trouble…

The United States Court of Appeals for the Fifth Circuit has delivered a monumental decision that could have catastrophic financial consequences for Planned Parenthood. In a recent ruling, the court rejected a procedural shield the abortion provider attempted to use to avoid a massive Medicaid fraud lawsuit. This keeps the organization on the hook in a legal battle that threatens penalties reaching nearly two billion dollars.

The controversy comes from allegations that Planned Parenthood affiliates in Texas and Louisiana improperly billed Medicaid after both states moved to terminate their eligibility. A whistleblower lawsuit, filed under the False Claims Act, asserts that the organization continued to take taxpayer money and failed to return the funds after their participation in the state programs was prohibited. 

Planned Parenthood sought to evade the lawsuit by claiming absolute immunity for the actions of their attorneys during the litigation process. Initially, an appellate panel sided with the abortion provider, but that decision was vacated last year.

On August 12, the Fifth Circuit court ruled almost unanimously to dismiss Planned Parenthood’s interlocutory appeal. The court found no basis for their immunity from suit, meaning the organization must now face the merits of the case in a trial court. This procedural defeat strips away their primary defense and leaves them vulnerable to full exposure under the law.

If the plaintiffs prove that Planned Parenthood knowingly committed Medicaid fraud, the financial devastation to the organization would be unprecedented. The False Claims Act allows for treble damages and severe civil penalties for every fraudulent claim submitted to the government.
